Perludem Director Responds to Bawaslu's Silon Access Report against KPU
Kaltimtoday.co - Khoirunnisa Nur Agustyati, the Executive Director of the Election for Democracy (Perludem), has addressed the recent report submitted by the Election Supervisory Board (Bawaslu) regarding the limited access to the Candidate Information System (Silon) by the General Election Commission (KPU) to the Election Organizers' Honorary Council (DKPP).
Ninis, as she is commonly known, stated that Bawaslu should not have reported KPU to DKPP in order to gain access to Silon. She highlighted that DKPP's jurisdiction is primarily centered around ethical matters and professionalism, and thus, DKPP does not have the authority to instruct KPU to grant access to Silon for Bawaslu.
"DKPP's role is not to instruct KPU to open Silon, as DKPP deals with ethical and professional matters. DKPP cannot mandate KPU to do so," Ninis stated in an interview on Friday (August 11, 2023).
However, if Bawaslu believes that KPU is acting unprofessionally by not responding to Bawaslu's requests to expand Silon's accessibility, then it would be appropriate for Bawaslu to report KPU to Bawaslu itself.
Ninis suggested that if Bawaslu is seeking greater access to information, it would be more fitting for the institution led by Rahmat Bagja to coordinate with the Central Information Commission (KIP) to evaluate which data should be exempted.
KPU has restricted access to Silon for Bawaslu, citing the presence of private data that needs to be safeguarded.
"While certain data is exempted, it does not mean that the documents are not accessible," Ninis explained.
Furthermore, she asserted that Bawaslu should utilize its authority to treat the limitations on Silon access as findings of administrative violations committed by KPU.
"Bawaslu now possesses significant authority compared to before, experiencing institutional transformation and wielding substantial power. It should view this as a finding; after all, there has been an administrative violation," Ninis emphasized.
Earlier, DKPP member Raka Sandi revealed that the report had been received by DKPP on Monday evening (August 7, 2023).
"The procedure for handling complaints submitted to DKPP is outlined in the DKPP regulations regarding procedural guidelines for the code of ethics of election organizers," Raka told reporters on Tuesday (August 8, 2023).
"In essence, there will be preliminary administrative verification. Subsequently, if the administrative criteria are met, the process continues with material verification," he elaborated.
Raka noted that the complaint alleging ethical violations by election organizers had been filed by Bawaslu against all KPU commissioners.
